The agreement between you and xGreen when you use our website, apps, cloud service and hardware.

By using the xGreen website, apps, cloud service or hardware, you agree to these Terms of Use. If you are using xGreen on behalf of a business, you accept them on its behalf. If you do not agree, please do not use the service. These terms are provided by [xGreen legal entity name and registered address].
xGreen consists of a control module and sensors, a control app that runs on your local network, and an optional cloud service for remote access and extra features. The app is included free with the module and is free to use on your local network. Cloud features require an active subscription (with any trial we may offer). We may improve, change or discontinue parts of the service over time.
You are responsible for keeping your login details and device access tokens secure and for activity that happens under your account. Tell us promptly if you believe your account or a module has been accessed without your permission.
Cloud subscriptions are billed in advance through our payment processor on the plan you choose. Unless cancelled, a subscription renews automatically for the same period. You can cancel at any time and keep access until the end of the paid period; unless the law requires otherwise, payments already made are non-refundable. If a subscription lapses, cloud features stop, but the module and the local app keep working.
You agree not to:
We grant you a personal, non-exclusive, non-transferable licence to use the xGreen software to operate your own greenhouse equipment. The software is provided free of charge with your hardware but remains our property; it is not sold to you. You may not copy, distribute or sublicense it beyond this use.
The xGreen module controls mains-powered and mechanical equipment. It must be installed and wired by a competent person in line with local electrical regulations and the equipment manufacturers’ instructions. You are responsible for safe installation, suitable protective devices, and any permits your site requires.
We work to keep the service reliable, and automation runs on the module itself so your greenhouse keeps operating even without internet. However, we do not guarantee uninterrupted or error-free operation of the cloud service, which may be affected by maintenance, connectivity, or events beyond our control.
The service and software are provided “as is” and “as available”, without warranties of any kind beyond those that cannot be excluded by law. xGreen is a tool to help you manage a greenhouse; it does not replace your own judgement and monitoring, and we do not warrant any particular growing result.
To the fullest extent permitted by law, xGreen is not liable for indirect or consequential losses, or for loss of crops, plants, profits or data arising from use of, or inability to use, the service. Nothing in these terms limits liability that cannot be limited by law (such as for death or personal injury caused by our negligence). Subject to that, our total liability is limited to the amount you paid us for the service in the 12 months before the claim.
We may update these terms from time to time. We will change the date at the top and, for material changes, let you know through the service. Continuing to use xGreen after a change means you accept the updated terms.
These terms are governed by the laws of Poland, and the courts of Poland have jurisdiction, unless mandatory consumer-protection law in your country of residence gives you other rights.
